Terms & Conditions

These terms and conditions are set out between “you” (the client) and “us” (Avenue1 Design).


They are set out in relation to any product or service we provide (referred to as the “project” or “service”).


These Terms and Conditions are subject to change.

Limitation of Liability

Avenue1 Design agrees that work will be carried out using good industry practice at a standard expected from a qualified person with relevant experience and that our work will be reasonably error-free.


Avenue1 Design will not be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the website, or from any errors that may be present in our work. This will apply even if Avenue1 Design has been advised of the possibility of such damages.

Design Services

Timescales

All timescales provided by Avenue1 Design are estimates. Avenue1 Design will not be liable to clients or other third parties for any damages, including but not limited to loss of profits, lost savings or other incidental, consequential or special damages arising from delivering any work within a given time-frame.


Avenue1 Design will not be liable for any extended timescales resulting from:

 

  • Lack or delay of correspondence from the client.
  • Slow or delayed delivery of content from the client.
  • Changes to the initial spec/proposal by the client.

 

Starting Work

Avenue1 Design will request all materials needed for the completion of the project, before any work is started. The client agrees to provide all material in a suitable format. If the relevant materials cannot be provided, We may provide a suitable alternative and charges may apply if we are required to change such materials at a later date.


Both parties will ensure that they have the legal right to use any materials provided by them, including text, graphics, photos, artwork and trademarks. The client agrees to hold harmless, protect and defend Avenue1 Design from any claim or suit arising from use of materials provided by the client.

Changes to Requirements

If a client submits changes to the agreed upon project scope and objectives, we will try to accommodate the changes at no extra cost. Changes we deem as significant that may affect the design or functionality of the site may be implemented at an extra cost, details of which will be provided to the client before actioning.

Previewing the Design

We will create your site using information collected during the initial stage of the process and the materials agreed upon and provided before work starts. 


Depending on the design package purchased, Avenue1 Design may provide mockups as part of our design services. We do provide an amendment stage once the initial design has been completed, the terms of which can be found below. 


When the site is completed, we will provide you with a link to preview your site. The preview will offer emulated examples of how the site displays on desktop, tablet and mobile devices. These emulations are for presentation purposes only and the final published site may look different on specific individual devices. 

Amendments

On delivery of the initial design, clients will have 14 days to request any changes or amendments to that initial design.


We will complete any changes we deem to be reasonable at no extra cost. 


Changes that we deem as substantial may result in additional charges, which will be outlined and provided for the client before any changes are made. The client can choose to withdraw their requested changes, or agree to pay the additional costs.

Website Hosting

Hosting services are invoiced in advance for a minimum of 1 year. You may pay for your hosting monthly or annually.


If invoices for your hosting services are not paid within the time stated on your invoice, your services may be suspended and your site will be taken offline.


Should you wish to cancel your hosting, we will require 30 days notice, after which your site will be taken offline. 


We do not offer refunds for any hosting fees paid in advance.

Hosting Support

If a problem with your website hosting arises, you may notify us via email or telephone and we will work to resolve any issues.


If the issue is a result of internal errors, we will work to resolve the problem as part of the hosting costs you have paid.


If the issue is found to be caused by the client or a third party to the client, we will work to resolve the problem and an additional charge may be applied. 

Design Support

Avenue1 Design may provide an ongoing design support service, for assistance with ongoing design changes to any website we have built.


The service will be agreed with the client prior to any payment and terms will be provided on a project by project basis.

Prices

Whilst we work to keep our prices competitive, all prices are subject to change. Any changes to prices will be reflected on our website and provided to clients before the start of any project. 


Some of our prices are provided for a limited time and are subject to renewal.

Payment

The client agrees to pay all invoices within the time stated on the invoice. 


On occasion and at our discretion, Avenue1 Design may deliver materials before payment is made.


All design services will be invoiced before work begins. No work will start until the invoice has been paid for in full, unless otherwise agreed with the Client.


Hosting invoices will be payable before any site is published. On payment of the hosting fees, the site will be published within 24 hours.

Termination of Design Agreement

If you have paid the initial design fee, you can end the agreement early if you change your mind about wanting the service or if you are not happy with the way the process is going. If you choose to terminate, we will provide a refund of the design fee you have paid, minus the cost of any services and materials provided to date and the value of the time spent working on the project so far. 


The value of time spent on the project will be calculated at £55.00 per hour.


We reserve the right to terminate any agreement if we are unable to continue with a project due to actions of the client. These actions include, but are not limited to, failure on the client’s part to respond to correspondence, refusal by the client to cooperate with us or the late payment of services.


In the event that the agreement is terminated by us, we will retain payment for any services or materials delivered and / or time spent working on the project. If this amount is less than than the design fee that has been paid, any remaining amount will be refunded to the client.

The advice and information provided by Avenue1 Design if for general information purposes and guidance only. You agree that any reliance placed on information we have provided is done so at your own risk.


We are not legal experts and it is your responsibility alone to ensure that you operate in a lawful manner.
